CONSUMER DISCLOSURE NOTICE (T&C)
PLEASE READ THIS NOTICE. IT CONSTITUTES PART OF YOUR CONTRACT FOR TRAVEL RELATED SERVICES. PLEASE CHECK YOUR DOCUMENTS WHEN YOU RECEIVE THEM. CALL US IF YOU HAVE ANY QUESTIONS OR CORRECTIONS. MOST DISCOUNT FARES INVOLVE RESTRICTIONS. CHANGING CARRIES OR FLIGHTS COULD RESULT IN THE AIRLINE DEMANDING AN INCREASED FARE.
Pixie Dust & Paradise Travel, Inc. (herein “Travel Agency” or “PDAPT”) is acting as an agent for suppliers (identified on the travel documents) in selling travel-related services, or in accepting reservations or bookings for services that are not directly supplied by this Travel Agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.) Travel Agency, therefore, shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage delay, inconvenience or injury to travelers or travelers’ companions or group members.
Travel agency does not guarantee any of such supplier’s rates, bookings, reservations, connections, scheduling, or handling of baggage or other personal effects. Travelers that have done due diligence, are aware of the quality of the hotel accommodations chosen, and agree that Travel Agency will not be responsible if they are not satisfied. Any price adjustment or charges for changes are the responsibility of the traveler.
Risks, Cancellation, and Insurance: Traveler assumes complete and full responsibility for, and hereby releases Pixie Dust & Paradise Travel, Inc. from any duty of checking and verifying any and all passport, Visa, vaccination, or other entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. Pixie Dust & Paradise Travel, Inc. shall not be responsible for any injuries, losses or damages in connection with terrorist activities, social or labor unrest, mechanical or structural integrity of air, sea, and ground transportation and accommodations, diseases, pandemics, local laws, terrorists acts, climatic conditions, Acts of God, Force Majeure, delays, changes or cancellation of travel due to weather conditions, hotel services, accidents or health related problems before or while in-transit to (e.g., an accident on the way to a tour), during, and after a tour, or any other actions, omissions, or conditions outside of Pixie Dust & Paradise Travel, Inc.'s control.
If travel plans are delayed or canceled for any reason there will be no refunds issued by Pixie Dust & Paradise Travel, Inc. including cancellations due to actual or threatened terrorist events and pandemics, or other unforeseen events. There will be no refunds due to fear of travel from actual or threatened terrorists’ events or pandemics, or other unforeseen events.
It is the traveler’s responsibility to protect their purchases and Travel Insurance is strongly recommended. Traveler is advised to obtain appropriate insurance coverage against these risks; information is available through this Travel Agency regarding travel insurance. Traveler’s retention of tickets, reservations, or bookings after issuance shall constitute consent of the above and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members.
By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of personal emergency.
Professional Planning Fee: In your initial planning call/email, we explained the planning fee. In order to perform the professional services required to plan and arrange your travel, a planning/research fee is required. This fee is due at the time of planning agreement and is non-refundable. In the unfortunate event that plans are cancelled or the itinerary is not fulfilled for any reason, the planning/research fee is non-refundable due to the work that Pixie Dust & Paradise Travel has already completed.
Credit Card Charges: Client understands that he/she shall be liable for any and all charges placed on credit cards in the event such charges are declined or charged back for any reason, including any unauthorized or fraudulent use of credit cards. Travel Agency shall not be held liable for any losses or damages associated with the fraudulent use of credit card and client shall hold PDAPT harmless from any, and all losses, damages or claims of any kind.
Your signed credit card authorization is a binding agreement for charging your trip and/or components of your trip, and as such, you waive any right to a chargeback in the case of trip delays, changes or cancellations for any cause (except fraud), and you agree to the refund policies and procedures as outlined in the terms and conditions by the supplier. In the event that you attempt (without our authorization) to chargeback or reverse a trip payment already made, we reserve the right to collect all additional costs, fees and expenses associated with such chargeback including, without limitation, attorney fees.
Final Payment: The final payment MUST be received by the communicated due date that is on all invoices sent. Final payments are NOT automatically charged. Travel Agency will email you a reminder for your final payments, but clients are ultimately responsible for ensuring their final balance is paid in full, by the due date. Pixie Dust & Paradise Travel, Inc. is not responsible for cancellations or late fees due to payments made after said date.
Cancellation Penalties: If a trip is booked by the Travel Agency, all deposits are non-refundable. Travelers will be charged a $100 per person administrative fee by PDAPT. This is separate than any fees or penalties levied by the supplier. If PDAPT booked airline tickets on your behalf, they are 100% non-refundable and subject to individual airline fees.
Changes to Reservations: Any changes made to your existing room/package reservation are subject to the current prevailing rates, promotions, and terms at the time of change. If the number of individuals occupying a room changes, the remaining individuals will be responsible for any additional costs incurred as a result of the change in the per-person occupancy rate.
Passports: Everyone, including children and infants, MUST have a valid passport book to travel internationally. The passport card is not acceptable. Failure to comply will result in denial of boarding, no refund, no exceptions. Passports are required to have 6 months validity from the date of return. Pixie Dust & Paradise Travel, Inc. is not responsible for passports in any way. Important: For international travel, booking name MUST MATCH YOUR PASSPORT EXACTLY (first, middle, last), no exceptions. Pixie Dust & Paradise Travel, Inc. requires you to furnish us with a clear copy of the picture page of your passport to book your international travel.
Air Travel: Once your flight has been ticketed with an airline, your ticket is non-refundable and non-transferrable and must abide by the terms of the carrier’s rules. For specific details, you can visit the carrier’s website. Flight details, including departure times are always subject to change by the airlines. It is the travelers’ responsibility to check in for their flight 24 hours in advance, and reconfirm all gates and times. It is also the travelers’ responsibility to arrive at the airport on time. We recommend arriving no less than two (2) hours early for domestic flights, and three (3) hours for international flights. We are required by law to tell you that Federal law forbids the carriage of certain hazardous materials, such as aerosols, fireworks, and flammable liquids aboard the aircraft. Baggage Fees: Due to the continual changes in airline baggage policies, it is suggested that you contact your airline’s website for up-to-date baggage fees and information. Baggage fees are not a part of an all-inclusive package. Pixie Dust & Paradise Travel, Inc. is not responsible for additional fees incurred for baggage or seating. Traveling with Children: Children under the age of 18 years old not traveling with both parents or legal guardians, may need to present a notarized letter from the absent parent/guardian granting permission to travel outside the United States, and to provide emergency medical care if necessary. The Travel Agency can provide client with the appropriate letters needed.
Travel Restrictions: Travelers with prior criminal convictions are responsible for ensuring that they are not restricted by the laws of the country to which they are traveling. Example: Passengers with DUI/DWI convictions may be prohibited from traveling to Canada. Passengers traveling without proper documentation or the correct destination requirements may be denied boarding or entry to an international destination, and will not be entitled to a refund. This is the sole responsibility of the passenger.
Travel After January 26, 2021: On January 12, 2021, the CDC issued an Order requiring all air passengers arriving to the United States from a foreign country to get a Covid-19 test no more than 3 days prior to their flight departure, and to provide proof of a negative result or documentation of having recovered from Covid-19 to the airline before boarding the flight. This order went into effect on January 26, 2021, and has been amended several times since.
